La residencia para inversores extranjeros

Por fin, hoy entra en vigor la nueva ley de emprendedores y con ello la posibilidad de obtener la residencia para todos aquellos inversores extranjeros que realicen una inversión significativa de capital en España.

¿Qué se considera un inversión significativa? 

Según la ley publicada ayer en el BOE en su Capítulo II art. 63 establece como inversión significativa:

a) Una inversión inicial por un valor igual o superior a 2 millones de euros en títulos de deuda pública española, o por un valor igual o superior a un millón de euros en acciones o participaciones sociales de empresas españolas, o depósitos bancarios en entidades financieras españolas.
b) La adquisición de bienes inmuebles en España con una inversión de valor igual o superior a 500.000 euros por cada solicitante.
c) Un proyecto empresarial que vaya a ser desarrollado en España y que sea considerado y acreditado como de interés general, para lo cual se valorará el cumplimiento de al menos una de las siguientes condiciones:
1.     Creación de puestos de trabajo.
2. Realización de una inversión con impacto socioeconómico de relevancia en el ámbito geográfico en el que se vaya a desarrollar la actividad.
3.   Aportación relevante a la innovación científica y/o tecnológica.

Concluido el año de vigencia del visado cabe la posibilidad de su prorroga bianual mediante la solicitud de la autorización de residencia, que será concedida siempre que se mantengan los requisitos de inversión que motivaron el visado inicial y que deberá acreditar de forma fehaciente, con los certificados emitidos por las entidades correspondientes.

Son grandes las expectativas que la entrada en vigor de esta ley ha estado suscitando en los últimos meses, tanto desde el lado de la oferta como de la demanda.  Países como China, Rusia y todo el continente iberoamericano llevan largo tiempo atentos a la evolución del trámite parlamentario y tenemos la certeza de que va a ser un revulsivo para las decisiones de inversión en los próximos meses.

Delegaciones chinas ya están visitando a promotores con la intención de comprender el proceso y ser los primeros en captar esa demanda latente en su país. Mercados como Argentina, con una gran colonia de ciudadanos españoles, Perú con una muy buena situación económica, Venezuela con una situación política difícil pueden provocar el desvío de las tradicionales inversiones en Miami hacia proyectos en España con este nuevo aliciente. No digamos nada de los ya muy celebres millonarios rusos que están poblando el levante español desde Barcelona hasta Alicante.

Por el lado de la oferta, también puedo asegurar que hay proyectos con una gran esperanza puesta en la publicación de esta ley. Promotores con los que trabajamos llevan meses abonando el terreno en esos destinos, dando a conocer sus proyectos, con la seguridad de que este puede ser el momento que estaban esperando para dar salida a las grandes inversiones realizadas en los últimos años.

Creo que es una magnífica noticia, muy esperada por todo el sector de viviendas de lujo y que estamos seguros va a dinamizar la demanda en los próximos meses.

Russian buyers rank third in 2012 overseas purchases in Spain.


According to the latest “2012 Real Estate Registry Statistics Report”, released by the Official Real Estate Register Bureau, Russian buyers rank third position in number of properties acquired in 2012, shifting place with Germany which moves to fourth place.
Russian demand in our country starts just before the Real Estate bubble began in 2007 in Spain. From that date it has been steadily growing 135% with 1.008 units in 2007 to 2.399 in 2012.

Currently Russian purchases represent 9.6% of total overseas units sold in Spain and 12% of total European ones.

If we take a look of where do they are looking for, we will find, most of Russian potential buyer like houses in the Mediterranean coast specially Torrevieja in Alicante also Valencia and Murcia, where there are a big settlement of Russian resident citizens. Secondly Barcelona, Marbella and recently Canary Island are growing rapidly according to one of the most popular real estate portal in Russia.
If we take care of prices, 60% of total enquiries look for properties below 100.000€, 15% below 150.000€, 15% below 300.000€ and a non-negligible 10% of enquiries for properties over 300.000€.

In summary, Russian overseas demand in Spain is clearly growing from 2007, looking for sun and good prices. Although there are a group of rich Russian people who has also to be satisfied with much more sophisticated requirements and we do not have to forget.

For sure this tendency will remain in the near future and who knows if could overtake France and UK who ranks first and second respectively.

Spain: A land of opportunities for overseas investors


If we go to early 2.000, during the years before the housing bubble burst in 2007, in Spain were being built in the vicinity of the 700,000 homes year, with a large speculative component, driven by low interest rates and ever-rising property prices, what homeownership turned into a very interesting investment option.

As of August 2007, there was a slowdown in demand has meant that much of the housing stock built and not sold, has become a major burden on the balance sheet of banks and savings banks, main financing actors of the projects.

Currently a new scenario is opened for visionary overseas profitable hunters
From a investor point of view, there are three benefits this situation bring in.

  • Large brand new finished housing stock with high quality construction level
  • Deep prices repositioning
  • Favorable financing conditions

First, according to the Ministry of Fomento in its report of January 2012 stated an excess of 676,038 new homes in our country available for sale, where Andalusia, Valencia and Catalonia represent over 50% of the total.


Second, as a result of the decline in demand there has been an unprecedented price repositioning in our country.

  • From the peak in the first quarter of 2008 prices level has fallen over 23%, in real terms, as reported by the Ministry of Fomento. (See chart).
  • By region, this price repositioning is greater where the excess of supply is higher, which has forced the various players to make economic efforts aimed to boost that demand. (See chart).



Finally very willingness of banks and saving banks to set up very favorable financing conditions, both interest rate levels, in some cases Euribor plus 0.50%, and the amount of funding that can vary over a cradle of 60% to even 100% of the total value of the home.

All these elements jointly with the pressing need to output the housing stock in the hands of financial institutions, has produced a great willingness from the government, financial institutions, developers, etc., to facilitate mechanisms to speed up the purchase process by private individuals and investment groups.

Apart of all this items, the recent announcement made by the government of Spain, who is considering to recognize the residence to those non EU citizens who buy a home worth more than € 160,000, make the decision to purchase a home in Spain an unprecedented investment opportunity, especially for Russian and Chinese people where the market is focusing mainly due to the high level of wealth and income .
We can summarize, that there are several reasons why foreign people could invest in our country

  • Main residence: There is a demand for professional needs in main cities Madrid y Barcelona, where there is currently a lack of Real Estate offer, both for rental and sale.
  • Second Home: The high quality construction of our stock, their situation in coastal areas, near golf courses or ski resort, makes this moment a great opportunity to purchase your second home in Europe.
  • Investment: Price levels, financing terms, rental facilities in coastal areas with high demand for European vacation, along with expectations of price recovery after the end of the crisis, put a new very attractive element to take in account.
  • Diversification of the investment portfolio from the groups with high income levels and strong economic capacity.
